Acceptance of Terms
By accessing or using ImagineIt (“the App”, “we”, “us”, or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.
Eligibility
You must be at least 12 years old to use ImagineIt. By using the App, you represent that you meet this age requirement.
3. Account Registration
You may need to create an account to access certain features. You agree to provide accurate and complete information and to keep your account credentials secure. You are responsible for all activity under your account.
Credits, Purchases, and Subscriptions
- ImagineIt uses a credit-based system for generating content. Credits may be purchased or earned through promotions.
- All purchases are final and non-refundable, except as required by law or the policies of the app store through which you made the purchase.
- Subscriptions, if offered, will auto-renew unless canceled in accordance with the app store’s policies.
- We reserve the right to change pricing, credit packages, or subscription terms at any time.
User Content and Conduct
- You are responsible for all content (prompts, images, videos, etc.) you submit or generate using ImagineIt.
- You agree not to use the App to create, upload, or share content that is illegal, harmful, offensive, infringing, or violates any third-party rights.
- You agree not to misuse the App, attempt to reverse-engineer it, or interfere with its operation.
AI-Generated Content
- ImagineIt uses artificial intelligence to generate images and videos based on your input.
- AI-generated content may be unpredictable, inaccurate, or inappropriate. We do not guarantee the accuracy, quality, or suitability of any generated content.
- You are solely responsible for how you use, share, or publish AI-generated content.
Intellectual Property
- You retain ownership of your original content. By using the App, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and store your content as necessary to operate the App.
- You may use AI-generated content for personal or commercial purposes, subject to these Terms and applicable law.
Termination
We may suspend or terminate your access to ImagineIt at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to the App or other users.
9. Disclaimers
- ImagineIt is provided “as is” and “as available.” We make no warranties, express or implied, regarding the App or any content generated by it.
- We do not guarantee that the App will be error-free, secure, or available at all times.
- We are not responsible for any loss or damage resulting from your use of the App or any AI-generated content.
10. Limitation of Liability
To the fullest extent permitted by law, ImagineIt AI Labs and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the App.
11. Indemnification
You agree to indemnify and hold harmless ImagineIt AI Labs, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the App or violation of these Terms.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of significant changes by posting the new Terms on our website or in the App. Your continued use of ImagineIt after changes are posted constitutes your acceptance of the new Terms.
13. Governing Law
These Terms are governed by the laws of the United States, without regard to its conflict of law principles.
